ECHR Condemns Greece for Firing Woman with AIDS

The Court of Human Rights condemned Greece, claiming that the Greek Justice accepted as lawful the dismissal of a Greek female worker suffering from AIDS.

The European Court of Human Rights condemned Greece for violation of the warranty which prohibits the discrimination and violation of the right to prevent private and family life regarding the case of an employee who suffers from AIDS.

The Court condemned Greece for the fact that Greek Justice accepted as lawful the dismissal of the woman. Her employer dismissed her after having been forced by her colleagues in order to ensure the harmonious cooperation among his staff, which was acceptable by the Court of Appeal and certified by the Supreme Court.

Judging the case of the Greek woman, who was dismissed after the revelation that she was a carrier of AIDS, the Court of Human Rights ruled that this decision was contrary to the Convention for the Protection of Human Rights.

The Court decided that the employee had been discriminated because of her disease and that national courts of Greece had based their decision on inaccurate information, that there was risk of  the disease spreading.
